Maker of Batman Porn Rip Off Suing Filesharers That Ripped Off His Movie
We often wonder, incredulously, when the internet will reach a limit on talking about superhero porn parody movies. Not that we think the production of such things should stop or that they’re not worth reporting on, we simply went through a period where we felt awash in a vast and unruly sea of Batman XXX: A Porn Parody information.
When does the idea of superhero porn parodies reach a point where we feel the need to report on them? What other facet of our news mandate does it have to intersect with for us to want to tell you about it?
File sharing and copyright issues, as it turns out.
This Friday, Axel Braun Productions, the makers of the aforementioned Batman porn parody, filed a complaint with U.S. District Court for the Northern District of West Virginia requesting the subpoena of the contact information of 7,098 IP addresses who they allege illegally downloaded their film.
According to CNet , Axel Braun Productions attorney is adopting a similar method to the one used by those representing The Hurt Locker earlier this year.
Attorneys… start the process by gathering Internet Protocol addresses belonging to people who allegedly shared the movie files. The attorneys then file a complaint in federal court naming the defendants “John Does.” A request is made of the court to issue subpoenas to each of the Doe’s Internet service providers to obtain the accused persons’ names and other information. The attorneys then offer those accused a chance to settle out of court.
If a person refuses to settle, then conceivably the attorneys representing the copyright owners will sue, although that has yet to happen. …critics of this approach say they doubt the attorneys will want to spend the money on potentially drawn-out litigation. [Axel Braun Productions’ attorney] told CNET last month that he isn’t bluffing and will sue.
Scary filesharing case? Yes. Should Axel Braun Productions have seen it coming? Yes. We’re not here to debate morality. We’d just like to point out that this would all be a little less ironic if Axel Braun’s movie wasn’t a parody that rests on the legacy of an intellectual property that he doesn’t own.
Needless to say, if someone told us that there was a lawsuit going on in connection to Batman XXX: A Porn Parody, this is not how we would have imagined it happening.
